PRIVACY POLICY
This Privacy Policy (“Policy”) sets out the basis which Topcon Positioning Asia (Thailand) Co., Ltd. (“we”, “us”, or “our”) may collect, use, disclose or otherwise process your personal data in accordance with the Personal Data Protection Act 2019 of Thailand (“PDPA Laws”). This Policy applies to personal data in our possession or under our control, including personal data in the possession of organisations which we have engaged to collect, use, disclose or process personal data for our purposes.
1. Depending on the nature of your interaction with us, we may collect a variety of personal data from you including but not limited to your name, identification number, passport number, contact details, postal address, residential address, email address, nationality, gender, date of birth, occupation details, personal data required for the purposes described below, and personal data that you have provided or made available to us.
2. We may collect and use your personal data for any or all of the following purposes:
a) Communication for the execution of business;
b) Business partner’s data management, processing of payments and receipts;
c) Organizing and facilitating events, seminars and exhibitions;
d) Providing products and/or services requested by you;
e) Sending information about products, services or events;
f) Provision of product warranty, support or maintenance;
g) Product development, conduct of questionnaire surveys, implementation of product and service monitoring programs;
h) Execution of contracts;
i) Tally and analysis of count of access to improve our website;
j) Verifying your identity;
k) Responding to, handling, and processing queries, requests, applications, complaints, and feedback from you;
l) Managing your relationship with us;
m) Processing payment or credit transactions;
n) Complying with any applicable laws, regulations, codes of practice, guidelines, internal policies, or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority;
o) Any other purposes for which you have provided the information;
p) To send you updates and marketing emails about our products, services, events, training, or company news including information similar to what you’ve previously purchased (you may unsubscribe from these emails at any time by following the instructions in our communications or contacting us directly);
q) To understand how visitors use our website and improve its features, content and overall experience for users;
r) To process and evaluate your job application and manage our recruitment activities; and
s) Any other incidental business purposes related to or in connection with the above.
3. You warrant that where you have disclosed personal data of third parties (e.g. next-of-kin, friends or referees) to us in connection with the abovementioned purposes, you have obtained the prior consent of such third parties for us to collect, use and disclose such personal data for such purposes, in accordance with any applicable laws, regulations and/or guidelines. In respect of minors (i.e. individuals under the age of 18 years) or individuals not legally competent to give consent, you warrant that you are the parent, guardian or person who has parental responsibility over them or the person appointed by the relevant authorities to manage their affairs.
4. Your personal data may be disclosed to our parent companies, subsidiaries and affiliates (collectively, “Affiliates”), and to any of our or our Affiliates’ service providers, agents, advisors, contractors, distributors and/or any government or regulatory authority, located within or outside of Thailand, for any of the purposes described in Clause 2 above. This may include transferring your personal data to a location or country which may not offer the same standard of protection of personal data as prescribed under the PDPA Laws. However, we will ensure that your personal data (including personal data transferred to a location or organisation outside of Thailand) is protected by means of reasonable security arrangements to prevent:-
(a) unauthorized access, collection, use, disclosure, copying, modification or disposal, or similar risks; and
(b) the loss of any storage medium or device on which personal data is stored.
Such reasonable security arrangements include but are not limited to:-
(a) implementing and updating computer security and network security;
(b) restricting access to confidential information on a need-to-know basis; and
(c) compulsory and prompt reporting of any information security breach.
5. In the event of an information security breach, we will comply with data breach notification requirements under the PDPA laws, where applicable.
6. Where your personal data is transferred to an organisation outside of Thailand, we will ensure that such organization will:-
(a) only use such personal data for the purposes mentioned in Clause 2 above and purposes that are reasonable as allowed under the PDPA laws; and
(b) adhere to the provisions in this Policy.
7. We rely on the accuracy of the information you provide. Please ensure that the personal data and related information provided by you to us is accurate, complete, not misleading and kept up to date.
8. Subject to our right to refuse and/or charge a fee under the PDPA laws, you may request to:-
(a) access, correct and/or update personal data which is inaccurate, incomplete or out of date provided that sufficient information is given to us to meet such request;
(b) submit any inquiries or complaints in respect of your personal data; or
(c) limit the processing of your personal data, including the personal data relating to other persons who may be identified from your personal data, by withdrawing your consent previously given to us.

10. We will respond to your request as soon as reasonably possible. In general, our response will be within fourteen (14) business days.
11. If you withdraw your consent or fail to supply to us your personal data, we may not be able to carry out the Purpose for which your personal data is required.
12. We may retain your personal data for as long as it is necessary to fulfil the purpose for which it was collected, or as required by the applicable laws. For example, it may be retained for 5 to 10 years after your relationship with us ends (as the case may be) to address any disputes that may arise during that period, or such longer period as required under the applicable laws. Upon the expiry of the necessary retention period, we will delete, destroy or dispose such personal data.
13. We will ensure that your personal data is protected by means of adequate administrative, security and technical safeguards.
14. As a data subject, you have the following rights in respect of your personal data pursuant to the PDPA laws subject to the restrictions, requirements and/or conditions provided under such laws:-
Right to Access | You have the right to access to your personal data and request to extract a copy of such personal data from us;

Right to Transfer | You have the right to receive your personal data including to transmit or transfer personal data to another data controller or to you except where such request is not possible due to its nature;

Right to Object | You have the right to object the processing of your personal data;

Right to Delete | You may ask us to delete, destroy or anonymize your personal data;

Right to Restrict | You have the right to ask us to restrict the processing of your personal data;

Right to Correct | You have the right to correct your personal data if it is incorrect, not current, incomplete or misleading;
|
Right to Withdraw Consent | Where we process your Personal Data based on your consent, you have the right to withdraw such consent granted to us; and
|
Right to Complain | In the event that we violate or fail to comply with the PDPA Laws, you can contact us to lodge a complaint. However, it does not affect your right to lodge a complaint with the relevant authorities in accordance with regulations and procedures provided under the PDPA Laws. |
15. This Policy applies in conjunction with any other notices, contractual clauses and consent clauses that apply in relation to the collection, use and disclosure of your personal data by us.
16. In the event of any inconsistencies between the English version and the Thai version of this Notice, the English version shall prevail over the Thai version.
17. We reserve the right to amend and update this Policy at any time. You may determine if any such revision has taken place by referring to the date on which this Policy was last updated. Your continued use of our services constitutes your acknowledgement and acceptance of such changes.
